The Federal Baseline

Until November, federal law permits hemp-derived THC gummies. But individual states can — and do — impose their own restrictions.

States Where Hemp-Derived THC Gummies Are Fully Legal

The majority of states follow the federal framework and allow hemp-derived THC products with no additional restrictions beyond the 0.3% delta-9 threshold. In these states, you can buy THC gummies at retail shops, cannabis cafes, and online with no issues:

Illinois, Florida, North Carolina, Tennessee, Georgia, Texas, Ohio, Missouri, Wisconsin, Indiana, Kentucky, Virginia, West Virginia, Pennsylvania, New Jersey, New York, Massachusetts, Maine, New Hampshire, Nevada, Arizona, New Mexico, Montana, Wyoming, Nebraska, South Dakota, North Dakota, and most others.
