The Hemp Industry Is Changing — Here’s What You Need to Know

What’s Changing?

The biggest shift is how THC is measured. The old rule only looked at delta-9 THC as a percentage of dry weight (the famous 0.3% threshold from the 2018 Farm Bill). The new law switches to a “total THC” approach that includes THCA and other THC variants.

There’s also a new limit on finished products: 0.4 milligrams of total THC per container. To put that in perspective, a single gummy containing 10mg of THC — which is standard today — would exceed the new limit by 25 times.

What Does This Mean for Hemp Edibles?

If enforced as written, many of the hemp-derived THC products currently sold across the country would become non-compliant at the federal level. That includes:

  • THC gummies above 0.4mg per package
  • THC-infused beverages and seltzers
  • Delta-8, HHC, and other synthetic cannabinoids
  • High-potency tinctures and edibles

However, it’s important to note that industrial hemp products like fiber, grain, and seed are NOT affected. And naturally occurring cannabinoids within the new limits remain federally legal.
