The hemp industry is facing its biggest shake-up since the 2018 Farm Bill. In November 2025, Congress quietly slipped a provision into a government spending bill that will fundamentally change what hemp products you can buy — and it takes effect November 12, 2026.

What Changed in the Law?
The 2018 Farm Bill defined hemp as cannabis with less than 0.3% delta-9 THC by dry weight. This created what many called the “hemp loophole” — products could contain significant amounts of THC per serving as long as the plant-level threshold was met.
The new law makes three critical changes:
1. Total THC Replaces Delta-9 THC
The old rule only measured delta-9 THC. The new rule measures total THC, which includes THCA, delta-8, delta-10, and other THC variants. This closes the door on products that used alternative cannabinoids to deliver psychoactive effects while staying technically legal.
2. Per-Container THC Limits
Perhaps the most impactful change: each container of a hemp product must contain no more than 0.4 milligrams of total THC. To put that in perspective, a typical delta-9 gummy contains 5-25mg of THC per piece. Under the new rules, an entire package couldn’t contain what one gummy currently holds.
3. Finished Product Testing
Instead of testing the raw hemp plant, regulators will now evaluate the finished product. This means the THC content of the gummy, beverage, or tincture you actually consume is what matters — not the plant it came from.
What Products Are Affected?
The short answer: most hemp-derived THC products currently on shelves. This includes:
- Delta-9 THC gummies and edibles — The vast majority won’t comply with the 0.4mg limit
- Delta-8 and delta-10 products — Now counted under total THC
- THCA flower — THCA converts to THC when heated, so it falls under total THC
- THC beverages — Most contain 2.5-10mg per serving, far above the new limit
- THC tinctures and oils — Same issue with per-container limits
What’s NOT Affected?
Industrial hemp used for fiber, grain, and seed is specifically exempted. CBD isolate products with truly negligible THC levels may still comply. Topical products (creams, balms) are in a gray area that the FDA may need to clarify.
The 2026 Farm Bill: Will It Save Hemp Products?
The House Agriculture Committee has advanced the 2026 Farm Bill, but it does not include language to delay or reverse the hemp product ban. Instead, it tightens the definition further by adopting the total THC standard for pre-harvest testing of hemp plants.
However, the HEMP Act (Hemp Economic Mobilization Plan) is a separate legislative effort that would create a regulated framework for hemp-derived cannabinoid products rather than banning them outright. Industry advocates are pushing hard for this legislation.
